ELEVATE LIABILITY WAIVER & PHOTO RELEASE

ELEVATE requires all new clients to carefully read and agree to our release form. This form is available in your WIX account to complete prior to your first class. 

 

PHYSICAL WAIVER

 

I am participating in Pilates/fitness classes, programs, workshops, and events offered by ELEVATE during which I will receive information and suggestions about Pilates, health, and fitness. I recognize that the activities I participate in at ELEVATE require physical exertion which may be strenuous and may cause aggravated physical injury, and I am fully aware of and willingly assume the risk and hazards involved. I understand that it is my sole responsibility to consult with a physician prior to my participation in any of the classes, programs, workshops, and events at ELEVATE. I represent and warrant that I am physically fit and have no medical condition which would prevent my full participation in these activities. In consideration of being permitted to participate in any of the classes, programs, workshops, and events at ELEVATE, I agree to assume full responsibility for any risk, injuries, or damages, known or unknown, which I might incur as a result of participation in the activity. I agree to inform my instructors of any physical limitations, discomfort and or injuries before or during classes and I take full responsibility for my own actions and my own limitations. In further consideration of being permitted to participate in any of the classes, programs, workshops, and events at PILATES BKLYN, I knowingly, voluntarily and expressly waive, renounce and disclaim any claim I have or may have against ELEVATE, its instructors, contractors, directors, partners, owners, and employees for loss, theft or damage of any personal property from the ELEVATE premises, for injuries or damages that I may sustain within the ELEVATE facility, and/or for injuries or damages that I may sustain as a result of participating in the classes, programs, workshops, and events at ELEVATE. I forever release, waive, discharge, and covenant not to sue ELEVATE for any injury or death caused by their negligence or other acts that are not intended to harm me.

 

 

PHOTO RELEASE AGREEMENT

I grant to ELEVATE, its representatives and employees the right to take photographs and videos of me and my property in connection with the above-identified purposes. I authorize ELEVATE, its assigns and transferees to copyright, use and publish the same in print and/or electronically. I agree that ELEVATE may use such photographs and videos of me with or without my name and for any lawful purpose, including but not limited to such purposes as publicity, illustration, advertising, and Web content. I hereby waive the right to receive any payment for signing this release and waive the right to receive any payment for ELEVATE’S use of any of the material described above for any of the purposes authorized by this release.

 

 

ETHICS AGREEMENT

 

I understand that the materials provided to me within this program are the intellectual property of ELEVATE I will not use, transfer, or reproduce any materials without the express written consent of ELEVATE. I understand that the formats and techniques instructed at the ELEVATE are the express property of ELEVATE. I will not use, reproduce, or cause to be reproduced any classes, programs, workshops, brands, or other intellectual property for commercial use without the express written consent of ELEVATE.
